Terms of Service

These Terms of Service ("Terms") govern your use of the website at www.abellex.com and any cabinetry design or fabrication services provided by Abellex Customes LLC ("Abellex," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.

1. Our services

Abellex designs and fabricates custom cabinetry and millwork in the State of Hawaii. All work is performed under a separate written proposal and contract that describes the scope, materials, schedule, and price for your specific project. These Terms apply alongside that contract; if there is a conflict, the signed proposal controls.

2. Quotes and proposals

Quotes are valid for 30 days from the date issued. Material and labor prices may change after that period. A project is considered booked only when a written proposal has been signed and the design or build deposit has been received.

3. Deposits and payment

Most projects require a non-refundable design fee, a 30% build deposit at the time materials are ordered, a progress payment at the start of fabrication, and final payment upon delivery. Specific terms are set in your proposal. We accept ACH, wire, and major credit and debit cards through Stripe. Past-due balances accrue interest at 1.5% per month or the maximum permitted by law, whichever is less.

4. Changes to scope

Once fabrication has begun, changes to the design, materials, or dimensions may not be possible and may incur additional fees. All change orders must be confirmed in writing before we will act on them.

5. Lead times and delays

Lead times provided in proposals are estimates based on current shop capacity and material availability. We are not responsible for delays caused by shipping, third-party trades, site readiness, force majeure, or changes you request after the project has been booked.

6. Delivery and site conditions

Installation is not part of our scope of work. You are responsible for engaging a licensed contractor to install our cabinetry and for providing a clean, safe, and accessible delivery location. We are not responsible for fitting issues caused by site conditions, third-party installers, or modifications made after delivery.

7. Warranty

We warrant our cabinetry against defects in materials and workmanship for one year from the date of delivery. Natural variation, movement, and patina in solid hardwoods are characteristic of the material and are not defects. The warranty does not cover damage from handling after delivery, misuse, accident, water exposure beyond ordinary household use, or modifications by others. 8. Title and risk of loss

Title to fabricated goods passes to you upon final payment. Risk of loss passes upon delivery to your site.

9. Intellectual property

All drawings, renderings, and design documents we produce remain our property and may not be reused, reproduced, or shared with another fabricator without our written permission. We may photograph completed work and use those photographs for portfolio and marketing purposes; let us know in writing if you would prefer we do not.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to your project or these Terms is limited to the amount you have paid us under the applicable contract. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Governing law

These Terms are governed by the laws of the State of Hawaii without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Honolulu County, Hawaii.
